ZMC Advisors, L.P. and its affiliates (“ZMC”, “we” or “us”) are committed to protecting the privacy of our website visitors. This privacy policy, together with the California Website Privacy Policy and the EEA-UK Website Privacy Policy Notice supplements (the “Privacy Policy”) provides information explaining whether and how we collect information about you when you visit our website or other websites we control and where this Privacy Policy is posted (the “Site”), and how we use such information. The Privacy Policy describes the manner in which we process your personal information and the measures we take to preserve the privacy and security of your personal information. For simplicity, we use the terms “personal information”, “personally identifiable information” and “personal data” in this Privacy Policy (and any additional jurisdiction-specific privacy notices) interchangeably. This Privacy Policy does not address our privacy practices concerning any personal information we collect as to our investors; we address those practices in separate notices sent to our investors or potential investors or make available within our LP portal.

This Privacy Policy constitutes a legally binding agreement between ZMC and you, the user of this Site. By entering and using this Site, you acknowledge your acceptance of, and agree to be bound by, the Privacy Policy stated herein, our Terms of Use and all additional terms incorporated by reference herein. If you do not agree to this Privacy Policy for any reason, please do not use this Site or share your personally identifiable information (defined below) with us as discussed below.

The information presented on or through the Site is made available for informational purposes only and should not be construed as investment advice. The information presented does not, and shall not be deemed to constitute an offer to sell, or a solicitation to any person to buy, any security or other investment. ZMC does not track its customers over time and across third party websites to provide targeted advertising and therefore does not respond to Do Not Track (“DNT”) signals. However, some third party sites do keep track of your browsing activities when they serve you content, which enables them to tailor what they present to you. For the avoidance of doubt, affiliate companies of ZMC (including portfolio companies) have different policies and administer them independently of ZMC itself.

We review the personal data we hold periodically and delete it securely. We will keep your personal data only for as long as is reasonably necessary for the purposes set out in this Privacy Policy, unless a longer retention period is required by law. This California Website Privacy Policy (the “California Privacy Policy”) supplements the Privacy Policy with respect to specific rights granted under the California Consumer Privacy Act of 2018 (as amended, the “CCPA”) to natural person California residents and provides information regarding how such California residents can exercise their rights under the CCPA. This supplement is only relevant to you if you are a resident of California as determined in accordance with the CCPA. Information required to be disclosed to California residents under the CCPA regarding the collection of their personal information that is not set forth in this CCPA supplement is otherwise set forth in the Privacy Policy. To the extent there is any conflict with the privacy requirements under the Gramm-Leach-Bliley Act and/or Regulation S-P (“GLB Rights”), GLB Rights shall apply.

EEA-UK Website Privacy Policy supplement

This EEA-UK website privacy policy supplement (the “EEA-UK Website Privacy Policy”) describes how we process and use personal information from visitors of the Site in accordance with the EU General Data Protection Regulation (“EU GDPR”), the Data Protection Act 2018, and any other laws applicable in the EU and/or the UK concerning the protection and/or processing of personal data (together, “EEA-UK Data Protection Legislation”).

You do not need to take any action as a result of this EEA-UK Website Privacy Policy, but you may have certain rights as described below in the section headed “Your Rights”.

Any Additional Personal Data We May Collect

As discussed in the “The Personal Information We May Collect” section of the Privacy Policy, the types of personal data we collect about you depends on the product or service you have requested from us and/or the nature of your interaction with us.

We do not collect any special categories of personal data about you (this includes details about your race or ethnicity, religious or philosophical beliefs, sex life, sexual orientation, political opinions, trade union membership, information about your health and genetic and biometric data), although there may be limited circumstances where we need to collect this type of personal data, or it is collected incidentally. Nor do we collect any information about criminal convictions and offences.

If we require your personal data due to a legal requirement or obligation or in order to perform a contract with you, we will make you aware of this at the time we collect your personal data, and the possible consequences of you failing to provide this personal data. Failure to provide this information means that we may not be able to provide our services or products to you. In this case, we may have to cancel a product or service you have with us but we will notify you if this is the case at the time.
